Terms of Use, Privacy, and Cookies

IAMBIC’s Terms of Use, Privacy Policy, and Cookie Policy explain how we collect, use, and protect your information when you order IAMBIC products and services, complete our virtual consultation, or use our website and app. This page covers data practices, HSA/FSA payments, your privacy rights, and cookie choices. For any request, contact legal@iambic.co.
1. About this Agreement
These Terms of Use and Sale (“Terms”) form a legally binding agreement between you and IAMBIC INC. and its affiliates (“IAMBIC,” “we,” “us,” or “our”). They govern your access to and use of IAMBIC’s information, products, and services, including our website, web application, mobile application, and any related media, tools, or channels (collectively, the “Platform”).
The Platform is intended for users 18 years of age and older. IAMBIC does not knowingly collect personal information from anyone under 18. If you believe we have collected information from a person under 18, contact legal@iambic.co and we will delete it.
2. Changes to these Terms
We may update these Terms periodically. If we make a significant change other than a pricing change addressed in Section 3, we will notify you by posting a notice on the Platform or sending you a notification. If you continue to use the Platform after we have notified you of changes, you will be considered to have accepted the updated Terms, except where prohibited by applicable law. Some jurisdictions do not allow unilateral updates to consumer terms, so this paragraph may not apply to you.
3. Orders, Pricing, and Service Relationship
IAMBIC footwear is made to order. Orders are confirmed once payment is processed. Pricing is published on the Platform and may change at any time without prior notice. We are not responsible to you or any third party for price changes, suspension, modification, or discontinuation of products. Exchange and return policies are published on the Platform and incorporated by reference.
As long as your account remains active, we use your Fit Profile (defined in Section 4.1) to design the fit of future IAMBIC products and services, provide Concierge service, and improve the design of your subsequent orders. This is what we refer to as the IAMBIC service relationship. Your service relationship is treated as inactive after 48 consecutive months with no orders, no Concierge contact, and no Platform login. Once inactive, we will destroy your identifiable Fit Profile data within the timeframes required by applicable law.
If you withdraw consent for Fit Profile data processing before we have started manufacturing your order, you are eligible for a full refund. Once manufacturing has begun, refund eligibility is governed by our standard return policy. For purposes of these Terms, manufacturing is deemed to have begun when your order enters production at our manufacturing partner’s facility, which is reflected in your order status on the Platform. You may view your current order status at any time through your account.
Despite our efforts, a product may occasionally be listed at an incorrect price due to a typographical, technical, or system error. If we discover that a product you have ordered was listed at an incorrect price, we will notify you and give you the option to confirm your order at the correct price or cancel it for a full refund. We reserve the right to cancel any order placed at an erroneous price, whether or not the order has already been confirmed.
4. Privacy Policy
This section describes how we collect, use, store, and share your personal information.
4.1 Information we collect and where it comes from
We collect three categories of information:
- Account and order information: name, shipping address, billing address, email, phone number, and order history.
- Fit Profile data: information collected through our virtual consultation, fit assessment, and ongoing service relationship. This includes foot scans; gait and wear inputs; survey responses about your lifestyle, comfort preferences, fit history, and foot health; and Concierge consultation notes. We treat this category as sensitive under applicable biometric, consumer health data, and consumer privacy laws.
- Platform usage information: device type, browser, IP address, pages viewed, referral source, and interaction data collected through cookies, pixels, and analytics technologies.
We collect this information from the following categories of sources:
- Directly from you, when you create an account, complete our virtual consultation, place an order, submit wear feedback, or contact us.
- Automatically from your device and browser, through cookies, pixels, tag management tools, and analytics technologies.
- From our e-commerce platform provider in connection with account creation, checkout, and order management.
- From our HSA/FSA payment processor in connection with HSA and FSA transactions, as described in Section 4.7.
- From our marketing and analytics partners, including email marketing providers, analytics providers, and advertising platforms.
4.2 How we use Fit Profile data
Fit Profile data is used to:
- Design, manufacture, and refine your IAMBIC products and services across your ongoing service relationship with us, including future orders.
- Provide Concierge service and respond to your inquiries about fit, comfort, and wear.
- Improve our fit models, consultation and scanning technology, and product development, as described in Section 4.3.
- Conduct and support research, as described in Section 4.4.
- Comply with the terms of grants, government funding, and research collaborations.
We retain identifiable Fit Profile data for as long as your IAMBIC service relationship remains active, so that we can provide ongoing fit refinement and Concierge service. The service relationship and the destruction timeline that applies after it ends are described in Section 3. Where applicable biometric or consumer health data privacy law requires earlier destruction, the shorter period applies. You may request earlier deletion by contacting legal@iambic.co, subject to the limits described in Section 4.6.
4.3 AI and model training
We use Fit Profile data to train and improve the artificial intelligence and machine learning models that power our fit technology and benefit all IAMBIC clients.
For model training that extends beyond your individual service relationship, we de-identify the data before incorporating it into our training corpus so that it cannot reasonably be linked back to you. Once de-identified, the data is no longer treated as your Fit Profile data and may be retained on an ongoing basis to improve our products. We do not sell or share Fit Profile data for third-party AI training.
Our AI models generate fit predictions and last designs used to manufacture your IAMBIC products and services. These outputs do not produce legal or similarly significant effects on you, and we do not use automated decision-making for credit, employment, housing, insurance, healthcare, or other consequential decisions. Where you have rights under state law to receive information about profiling or automated decision-making, you may exercise them by contacting legal@iambic.co.
4.4 Research use
IAMBIC conducts and supports research with academic institutions, scientific collaborators, and government agencies. This research is part of the obligations we accept under National Science Foundation (NSF) grants, Center for Biotechnology programs, and other public funding sources. Research use includes:
- Sharing Fit Profile data with named research partners under written agreements that restrict the partner’s use of the data to the research purpose.
- Submitting de-identified or aggregated data to research repositories where required by grant terms.
- Publishing scientific findings derived from aggregated or de-identified data.
Before we share identifiable Fit Profile data with a research partner, we either obtain your separate authorization or rely on de-identification consistent with applicable law. Your separate authorization for research sharing is obtained through a dedicated, standalone consent that is distinct from your acceptance of these Terms and from the Fit Profile consent described in Section 4.6. Each such authorization (i) identifies the specific research purpose or program, including the relevant grant or public funding source where applicable; (ii) identifies the categories of named research partners who may receive the data; (iii) describes the categories of Fit Profile data to be shared; and (iv) states the duration of the authorization and how to withdraw it. We present this authorization to you before any identifiable Fit Profile data is shared for that purpose, and we record the date and scope of each authorization you provide. A summary of your current research authorizations is available on request at legal@iambic.co. Where your authorization is required, you may withdraw it for future research sharing without affecting our ability to fulfill your orders. To withdraw authorization, contact legal@iambic.co.
4.5 How we share information
We share Fit Profile data only with the following categories of recipients, for the purposes described in Sections 4.2 through 4.4:
- Manufacturing partners, including our production facilities in Portugal, who use this data to produce your IAMBIC products.
- Research partners, as described in Section 4.4.
- Service providers who support our fit technology, consultation, and scanning operations, including IT, analytics, and professional advisors.
Where we share Fit Profile data, we require recipients to use the data only for the purpose we authorize and to handle it consistent with applicable law. We do not sell, lease, or trade your Fit Profile data.
We share account and order information and Platform usage information with the following additional categories of recipients:
- Our e-commerce platform provider for account management, checkout, and order processing.
- Our HSA/FSA payment processor in connection with eligible transactions, as described in Section 4.7.
- Shipping carriers for order delivery.
- Marketing and analytics partners, including email marketing providers, analytics providers, and advertising platforms, as described in Section 4.8.
- Service providers who support our operations, including IT, client support, and professional advisors.
- Affiliates and referral program partners, where you participate in a referral or affiliate program offered by IAMBIC.
Across all categories of information, we may also share information with:
- Successors and acquirers in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, including due diligence related to any such transaction.
- Recipients required by law, court order, subpoena, or other legal process.
4.6 Notice and consent for Fit Profile data
Fit Profile data may include biometric identifiers (such as 3D foot scans and gait data) and consumer health data (such as survey responses about foot health, pain history, or comfort needs). If you are a resident of Illinois, Texas, Washington, or another state with a biometric privacy or consumer health data privacy law, the following applies:
- We collect Fit Profile data, including biometric identifiers and consumer health data, for the purposes described in Sections 4.2, 4.3, and 4.4.
- We retain Fit Profile data for the duration of your IAMBIC service relationship as described in Section 3, subject to applicable law, whichever requires earlier destruction.
- We may share Fit Profile data with the categories of recipients described in Section 4.5.
- We do not sell, lease, or trade your Fit Profile data.
- Before we collect Fit Profile data through any channel, including our virtual consultation, in-app scanning, or Concierge intake, we provide separate, purpose-specific written disclosures and obtain your written consent. Each material purpose, including manufacturing and ongoing service, product research and development, AI model training, and research partnerships, is identified separately.
By completing the consent process and submitting Fit Profile data through any IAMBIC channel, you provide informed written consent under the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act (CUBI), and the Washington My Health, My Data Act.
You may withdraw consent at any time by contacting legal@iambic.co. Withdrawal of consent may end our ability to fulfill or service your order or future orders. If you withdraw consent before we have started manufacturing your order, you are eligible for a full refund.
4.7 HSA/FSA payments
IAMBIC accepts HSA and FSA card payments through a certified third-party payment processor. The current processor and its privacy practices are identified on our HSA/FSA information page at iambic.co/pages/hsa-fsa. We may change processors from time to time and will update that page accordingly.
Our HSA/FSA payment processor is a separate business that determines its own purposes and means of processing the information it collects from you. When you choose HSA or FSA at checkout:
- The processor handles your card data directly. IAMBIC does not store payment card data.
- The processor collects and processes information necessary to confirm HSA/FSA eligibility and complete the transaction, including order details and the products purchased.
- The processor may collect additional information from you to verify eligibility, including health-related attestations or letters of medical necessity if its program requires them.
- The processor’s handling of your information is governed by its own privacy policy, not by this Privacy Policy. A link to the current processor’s privacy policy is available on our HSA/FSA information page.
IAMBIC products and services are not a medical device. IAMBIC does not provide tax or medical advice. Eligibility of IAMBIC products and services for HSA or FSA reimbursement depends on your plan administrator’s determination and on the verification performed by our payment processor, not on any representation by IAMBIC.
4.8 Marketing and advertising
If we use your personal information for newsletters or other marketing, we will seek your permission and provide an opportunity to decline. You may withdraw consent at any time by contacting legal@iambic.co.
We use the following categories of third-party platforms to deliver, measure, and analyze marketing and advertising:
- Email marketing providers, for newsletters and client engagement.
- Analytics providers, including via tag management tools, for website analytics.
- Advertising platforms, including pixel-based measurement, for advertising delivery and measurement.
These platforms receive limited identifiers (such as hashed email or device data) and online activity. Under the California Consumer Privacy Act (CCPA) and similar laws in other states, this activity is treated as “sharing” for cross-context behavioral advertising. You may opt out of this sharing using the “Do Not Sell or Share My Personal Information” link in the Platform footer or described in Section 4.11.
If you provide your mobile number and opt in to receive SMS or text messages from IAMBIC, we will send you marketing, transactional, and service-related messages, including order updates, fit guidance, product launches, and promotional offers. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time or HELP for assistance. Your consent to receive SMS messages is not a condition of any purchase. We do not sell or share your mobile number or SMS opt-in data with third parties for their own marketing.
4.9 Sensitive personal information
Under the California Privacy Rights Act (CPRA) and similar laws in other states, certain categories of personal information are treated as “sensitive personal information,” including biometric information processed for identification, health data, and other categories. While IAMBIC does not process Fit Profile data for identification purposes, we treat Fit Profile data as sensitive given its biometric and consumer health data components. You have the right to limit our use of sensitive personal information to what is necessary to provide our products and services. To exercise this right, contact legal@iambic.co or use the “Limit Use of Sensitive Personal Information” link in the Platform footer.
4.10 Financial incentives and affiliate programs
From time to time, IAMBIC may offer referral programs, affiliate programs, loyalty incentives, or similar programs that provide a benefit (such as a discount, credit, or commission) in connection with the collection or use of your personal information. Where we offer such a program:
- We will disclose the material terms of the program at the point you opt in, including the type of personal information collected, the value of the incentive, and how to opt out.
- Your participation is voluntary. You may withdraw from any such program at any time by contacting legal@iambic.co.
- We do not condition your access to IAMBIC products and services on participation in a financial incentive program.
If you are a California resident and participate in a financial incentive program, the program-specific notice satisfies the requirements of Cal. Civ. Code Sec. 1798.125(b).
4.11 Your rights and how to exercise them
Depending on where you live, you may have the right to:
- Know what personal information we collect, use, and disclose.
- Access a copy of your personal information.
- Correct inaccurate information.
- Request deletion of your information.
- Opt out of the sale or sharing of your information for targeted advertising.
- Limit our use of sensitive personal information.
- Withdraw consent for Fit Profile data collection.
- Receive a copy of your information in a portable format.
- Appeal a denial of any of these rights, as described below.
How to submit a request
To exercise any of these rights, contact legal@iambic.co or write to IAMBIC INC., Attn: Legal, at the address in Section 16. California residents may also use the “Do Not Sell or Share My Personal Information” link and the “Limit Use of Sensitive Personal Information” link in the Platform footer.
Identity verification
To protect your information, we verify your identity before responding to a rights request. We will ask you to confirm information we already have on file (such as your email, order history, or other account details). For sensitive requests, including deletion of Fit Profile data, we may ask for additional verification proportionate to the sensitivity of the data.
Authorized agents
You may use an authorized agent to submit a rights request on your behalf. We require the agent to provide written authorization signed by you, and we may contact you directly to confirm. Authorized agents registered with a state regulator must follow that state’s requirements.
Response times
We will confirm receipt of your request within 10 business days and respond within 45 days of receiving a verifiable request. If we require additional time, we will notify you within the initial 45-day period and may extend our response by an additional 45 days, for a total of 90 days. We do not discriminate against you for exercising your privacy rights.
Right to appeal
If we deny your rights request in whole or in part, you may appeal by writing to legal@iambic.co with the subject line “Privacy Rights Appeal.” We will respond to your appeal within 60 days. If we deny your appeal, we will inform you of the basis for the denial and provide information on how to submit a complaint to your state’s Attorney General or applicable enforcement agency.
State-specific rights
Residents of states with comprehensive consumer privacy laws have specific rights under those laws, including the appeal rights described above. These states currently include California, Virginia, Colorado, Connecticut, Texas, Utah, Oregon, Montana, Iowa, Tennessee, Delaware, New Hampshire, Maryland, Minnesota, Indiana, Kentucky, Rhode Island, and New Jersey, among others, and the list continues to expand. Washington residents have additional rights under the Washington My Health, My Data Act; contact legal@iambic.co for details.
Marketing transparency requests
California residents may request, once per calendar year, a list of the categories of personal information we disclosed to third parties for those parties’ direct marketing purposes during the prior calendar year, along with the names and addresses of those third parties (Cal. Civ. Code Sec. 1798.83). Residents of Delaware, Nevada, and other states with similar marketing disclosure laws may have comparable rights and may submit a request using the same process. To make a request, contact legal@iambic.co with the subject line “Marketing Transparency Request.”
Universal opt-out signals
We honor recognized opt-out preference signals, including Global Privacy Control (GPC), where required by applicable law.
4.12 Data retention
We retain personal information for the periods described below, except where a longer or shorter period is required by law:
- Account and order information: for the duration of your IAMBIC service relationship plus 7 years to meet tax, accounting, and warranty obligations.
- Fit Profile data: for the duration of your IAMBIC service relationship as described in Section 3, subject to the destruction requirements of applicable biometric and consumer health data privacy law.
- De-identified data used for AI training and product improvement: retained on an ongoing basis once de-identified, as it is no longer linked to you.
- Platform usage information: up to 2 years, or shorter where required by cookie settings or applicable law.
- Marketing information: until you withdraw consent or unsubscribe, plus a reasonable period to record your preference.
4.13 Data security and breach notification
We maintain administrative, technical, and physical safeguards designed to protect your information. No system is fully secure, and we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify affected individuals without undue delay and notify regulators within 72 hours of confirming the breach, except where applicable law requires a different timeframe.
4.14 Geographic scope
IAMBIC operates in the United States and serves United States residents in all 50 states and the District of Columbia. We do not direct our Platform to residents of the European Union, the European Economic Area, the United Kingdom, or other jurisdictions outside the United States, and we do not knowingly collect personal information from residents of those jurisdictions. If you access the Platform from outside the United States, you do so on your own initiative.
5. Cookie Policy
Cookies are small text files stored on your device when you visit a website. We use cookies and similar technologies, including pixels and tag management tools, to:
- Operate and secure the Platform (strictly necessary).
- Remember your preferences (functional).
- Measure how the Platform is used (analytics).
- Deliver and measure advertising (marketing).
You can manage your cookie preferences through our cookie banner or your browser settings. Disabling certain cookies may affect Platform functionality. We honor recognized opt-out preference signals (such as Global Privacy Control) where required by applicable law. We do not currently respond to legacy “Do Not Track” browser signals because no uniform standard has been adopted; we will update this policy if that changes.
The Platform may contain links to third-party websites and services that we do not control. We are not responsible for the privacy practices, content, or security of those external sites. We recommend reviewing the privacy policy of any third-party site before providing your information.
6. Intellectual Property
All content on the Platform, including text, graphics, logos, images, software, and IAMBIC product designs, is owned by IAMBIC or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
7. Your Content
If you submit reviews, photos, testimonials, or other content to the Platform, you grant IAMBIC a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, and distribute that content in connection with IAMBIC’s business. This license does not apply to, and you do not grant any license in, any Fit Profile data or any biometric identifiers, consumer health data, or other health-related information, even where submitted as or together with a photo, review, or testimonial. Any such data is governed solely by the Privacy Policy in Section 4 and the consent and authorization provisions that apply to it, and not by this Section 7. You represent that you own or have the right to share the content and that it does not violate any third-party rights.
8. Account Suspension and Termination
You may close your account at any time by contacting concierge@iambic.co. We may suspend or terminate your account or access to the Platform if you materially breach these Terms, misuse the Platform, or where required by law. Termination of your account does not by itself delete your Fit Profile data; following termination, your Fit Profile data is handled in accordance with the service relationship and retention provisions in Sections 3 and 4.12. The sections that by their nature should survive — including Intellectual Property, Your Content, Disclaimers and Limitation of Liability, Indemnification, Arbitration and Class Action Waiver, and Governing Law — survive the termination of your account or these Terms.
9. Disclaimers and Limitation of Liability
The Platform and IAMBIC products and services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, IAMBIC disclaims all warranties, express or implied. To the maximum extent permitted by law, IAMBIC’s total liability for any claim arising out of these Terms or your use of the Platform will not exceed the amount you paid IAMBIC in the 12 months preceding the claim.
Nothing in this Section limits remedies that cannot be limited under applicable law, including statutory damages and remedies available under state biometric privacy and consumer health data privacy laws, or IAMBIC’s liability for fraud, gross negligence, willful misconduct, or personal injury caused by IAMBIC. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you.
10. Force majeure
IAMBIC is not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disaster, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, labor dispute, governmental action, embargo, failure of utilities or telecommunications, or any disruption, shortage, or unavailability affecting our supply chain or manufacturing partners, including our production facility in Portugal. If a force majeure event materially delays or prevents manufacturing or delivery of your order, we will notify you and may, at our option, extend the time for performance or cancel the affected order. If we cancel an order under this Section before manufacturing has begun, you will receive a full refund. If a force majeure event arises after manufacturing has begun, we will work with you in good faith to determine an appropriate remedy, which may include rescheduling production or a partial or full refund.
11. Indemnification
You agree to indemnify and hold harmless IAMBIC and its affiliates, officers, employees, and agents from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the Platform.
12. Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or IAMBIC products and services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.
You and IAMBIC agree that any arbitration will be conducted only on an individual basis and not in a class, collective, consolidated, or representative action. You and IAMBIC waive any right to a jury trial and any right to participate in a class action.
Nothing in this Section prevents you from seeking public injunctive relief in a court of competent jurisdiction to the extent such relief cannot be waived under applicable law.
If any portion of this Section 12 is found unenforceable, the unenforceable portion will be severed and the remainder of this Section 12 will continue to apply, except that if the class action waiver is found unenforceable, this entire Section 12 will be void.
You may opt out of this arbitration agreement by sending written notice to legal@iambic.co within 30 days of first agreeing to these Terms. Your notice must include your name, address, and a clear statement that you want to opt out of arbitration.
13. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles. For any claim not subject to arbitration, you and IAMBIC submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York, unless applicable law requires otherwise. Nothing in this Section limits your ability to assert rights or remedies available to you under the laws of your state of residence, including state biometric privacy and consumer health data privacy laws.
14. Accessibility
IAMBIC is committed to making the Platform accessible to people with disabilities. If you encounter accessibility barriers or need assistance, contact legal@iambic.co.
15. Severability
If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

The most interesting thing about them being crafted just for me is how well they fit. And I had never even noticed that my shoes didn't fit right. My other shoes don't hurt me - they just slosh around. With these, the heels actually stay on the whole time and it fits snugly yet still comfortably. And I'd never experienced that before. They just stay comfortable all day.
As a runner, as an athlete, just knowing that I'm doing a good service to my body is incredible. It’s the reason that I love my IAMBIC shoes. It's that precision that makes me feel safe to walk down the street, get on the subway, do my commute, bring my kids to school, and not feel concerned that I'm doing it in a shoe that doesn't fit right or that doesn't feel good.
The thing that I was surprised by the most with the precision fit is that any pressure points that I had been feeling with the shoes that I previously came in wearing were completely gone. I was wearing a shoe that wasn’t too tight. It wasn’t too loose. The sole fit just right. Total comfort. That’s the best way to put it.
I deal with chronic foot pain, and a lot of it comes from shoes that do not really fit. When I wear my IAMBICs, I notice less pain and they are incredibly comfortable. I do not worry about support, and I even get compliments on them when I am out, which feels great.
A lot of shoes feel fine for a short walk but not for hours. What I like about IAMBIC is that it feels snug and comfortable, yet substantial enough for long walks without discomfort. That matters to me, and the shoe has really delivered on that.
The first time I tried my IAMBICs, I noticed the difference right away. I have small feet, so most shoes either do not fit or are uncomfortable somewhere. Knowing these were tailored to my foot was meaningful. They are truly comfortable and still versatile in style, which is rare to find.
I think we’re all placed on this earth as unique individuals. None of us are really off the rack in terms of sizing. So for me to have that experience of having something made specifically for me that fit perfectly was something that was a little bit mind blowing. And once I got the shoes, I tried them on, they looked great, they felt great. And honestly, they fit like a glove.
In motorsport, a millimeter matters. My IAMBICs are built with that same precision, and you can feel it when you move. They remind me of the exactness you find in high-performance machines, translated into footwear.
